Speaking Truth To Power

Appellant sued in the District Court, seeking relief for procedural deficiencies in proceedings before the Immigration and Naturalization Service (INS),1  having the object of overturning an INS decision withdrawing appellant's status as an approved school for attendance by nonimmigrant alien students under the provisions of the Immigration and Nationality Act, 8 U.S.C. § 1101(a) (15) (F). On appellee's motion to dismiss the complaint and cross motions of the parties for summary judgment the District Court granted appellee's motion for summary judgment. Appellant raises on appeal the question whether its status has been revoked consistently with the standards of procedural due process of law. We reverse, without prejudice to renewal of proceedings which fall within guidelines which emerge from our decision.

The College had been approved since 1953 as an institution of learning for attendance by nonimmigrant students,2  under 8 U.S.C. § 1101(a) (15) (F), which refers in the following terms to such students and institutions:

Dr. Suzanna Blackwell Dies At The Age Of 94

Founder of Blackwell  Business College

Washington Post:  February 19, 1983

Suzanna Blackwell, 94, (1889-1983), who founded and operated Blackwell Business College in Washington for 41 years, died Feb. 15 at George Washington University Hospital of pneumonia.

Miss Blackwell, who was born in Cokesbury, S.C., attended Benedict College in Columbia, S.C.,(https://benedict.edu/about-benedict/), and taught in public schools in South Carolina until she came to Washington in 1918.

She was a secretary for government and attended a night law school until 1923, when she opened the Blackwell Realty Co., which she operated until her death. In 1941, she started the Blackwell Business College.

Miss Blackwell was a member of the U.S. Supreme Court Bar, the D.C. Bar, the South Carolina Supreme Court Bar, the American Bar Association and the National Bar Association. She also was a member of Nineteenth Street Baptist Church.

Survivors include a brother, Joel D. Blackwell of Washington.

At age eleven, Peters taught himself to type, and in a few years his typing speed was impressive enough to qualify him for local typing competitions. He became the world champion of speed typing, clocking speeds of over 100 words per minute. In 1934 he turned his skill into an opportunity for other African Americans, opening the Cortez Peters Business College in Washington, D.C. It was the first black-owned business school of its kind and combined with the branches Peters opened in Chicago and Baltimore, the business college trained an estimated 100,000 students over forty years. Featuring subjects like typing, shorthand, filing, sales, IBM card punch and business law, the Cortez Peters Business College became one of the few private schools in the country to offer young African Americans entrance into the white-collar world. His son, Cortez Peters, Jr. took over the business school and his father’s world record, clocking up to 140 words per minute. He even set his own record of typing 99 words per minute while blindfolded and wearing mittens!
HistoryMaker Hermene Hartman attended Cortez Peters Business College in Chicago at the age of nine because of the financial stability it offered. “My mother kind of growing up without, at one point, a key point in her life without parents, without support, is that you'll always be able to take care of yourself. And if you have a basic business skill, you can always type, you can always--I--you can always go take shorthand, you can always get a job. So it was about being employable early, no matter what, whether you had a college degree or not. I started typing, fooling around in my dad's [Herman Hartman] office probably about seven years old, but I started taking typing when I was about eleven, twelve years old from CortezPeters Business College [Chicago, Illinois]. Can you see me, eleven years old? I was actually taking--taking—business courses, but my mother was determined that probably by fourteen, fifteen years old, I would be equipped if I had to—to take care of myself. And I think that was a little fear or something that she had lingering from her childhood, but indeed it worked for me.”
