Supreme Court Decision A Big Set Back

The Slaughter-House Cases (1873) was a landmark 5-4 Supreme Court decision ruling that the 14th Amendment's "privileges or immunities" clause only protects federal rights, not state citizenship rights. It upheld a Louisiana monopoly on New Orleans slaughterhouses, effectively limiting the amendment's ability to protect civil rights against state infringement. 

Key Aspects of the Slaughter-House Politics and Case:

• Context: After the Civil War, Louisiana granted a 25-year monopoly to one company for all slaughtering in New Orleans, claiming it was for sanitation, which forced over 1,000 independent butchers out of business.
• Butchers' Argument: The butchers argued this monopoly violated the 13th Amendment (involuntary servitude) and the 14th Amendment (equal protection, due process, and privileges or immunities).
• Court's Decision: The Court ruled the monopoly was a valid exercise of state police power. It narrowly interpreted the 14th Amendment, stating it only protected rights related to federal citizenship (like traveling to the capital or using sea ports), not the right to pursue a trade.
• "Privileges or Immunities" Clause: This decision essentially made the Privileges or Immunities Clause of the 14th Amendment a "dead letter," restricting its intended power to protect individual rights from state regulation.
• Significance: While the decision was a setback for Reconstruction-era civil rights protections, it strengthened state authority, yet laid the groundwork for future, broader interpretations of the 14th Amendment via the Due Process Clause (selective incorporation).
